Summary of the dispute

On 12 October 2020, Premier Energy Supply approached the Energy Community Secretariat with regard to the recognition of the costs of financing the working capital for the past three years. ANRE replied on 3 November 2020.

In the following months, the parties and the Facilitators exchanged proposals based on European best practices and Energy Community principles. One of the main topics of discussion was whether it is permitted, under both Energy Community law and Moldovan secondary legislation, to recognize the accrual of positive tariff deviations as a legitimate way to finance the cost of the working capital.
