Former Yugoslav Republic of Macedonia becomes first Contracting Party to support the High Ambition Coalition in global climate negotiations

Yesterday, former Yugoslav Republic of Macedonia supported the High Ambition Coalition, signing up to the "Statement on Stepping up Climate Ambition". The instrument brings together developed and developing countries sharing the highest level of ambition in the international climate talks. The statement was endorsed by Mr. Jani Makraduli, Deputy Minister for Environment and Physical Planning of Macedonia. The Secretariat strongly supports former Yugoslav Republic of Macedonia in its climate ambitions.

Georgian Deputy Minister of Economy visits Energy Community Secretariat

Today, Director Kopač held a working meeting with Ms Natia Turnava, Deputy Minister of Economy and Sustainable Development of Georgia, at the premises of the Energy Community Secretariat in Vienna. The meeting focused on Georgia’s progress in reforming its energy sector in line with the country’s obligations under the Energy Community Treaty.

Energy regulators across Europe and the Eastern and Mediterranean region sign cooperation arrangement

on 12 December 2018

A signing ceremony held in Vienna, Austria, brought together the Presidents of three regional
associations of energy regulatory authorities. Presidents Garrett Blaney of CEER, Giorgi Pangani of the ECRB and Gülefşan Demirbaş of MEDREG signed a Cooperation Arrangement that will
strengthen regulatory cooperation between energy regulators across Europe through to the
Mediterranean, South East Europe and Black Sea regions.

Energy Community side-event highlights challenges and opportunities in shifting to a just, low-carbon transition at COP24 in Katowice

On 10 December 2018, the Energy Community Secretariat, with the support of the Polish Government under the COP24 Presidency, held the side-event “Shifting to a low-carbon economy: Just transition pathways in the Energy Community and beyond” at the twenty-fourth session of the Conference of the Parties (COP24) to the United Nations Framework Convention on Climate Change (UNFCCC) in Katowice. For the first time, the Energy Community Secretariat participated to the climate COP as an observer organization.

Energy Community Regulatory Board sets priorities for upcoming year, takes stock of 2018 deliverables

At its 41st plenary meeting, the Energy Community Regulatory Board (ECRB) set out its objectives and priorities for the upcoming year. The Work Programme 2019 includes the continuation of monitoring reports on gas and electricity wholesale and retail markets and transparency of the gas sector. A deeper focus will be put on the implementation of new acquis, in particular the Third Package gas and electricity network codes, and the provision of coordinated regulatory input to support electricity market coupling.

Secretariat launches EU4ENERGY project to update natural gas transmission tariff methodology in Georgia

On 5 December, the Georgian National Energy and Water Supply Regulatory Commission (GNERC) hosted the launch of the EU4Energy technical assistance project to support Georgia in updating its gas transmission tariff methodology in compliance with the provisions of the Network Code on Harmonised Tariff Methodologies adopted on 28 November 2018 in Skopje by the Energy Community’s Permanent High Level Group.

16th Energy Community Ministerial Council adopts key energy infrastructure projects, sets direction for adopting 2030 energy and climate targets

on 29 November 2018

Today’s 16th Ministerial Council took key decisions for the future of the Energy Community under the chairmanship of H.E. Kreshnik Bekteshi, Minister of Economy of former Yugoslav Republic of Macedonia. Opening host speeches by Prime Minister H.E. Zoran Zaev and Deputy Prime Minister H.E. Koco Angjushev underlined that energy has no boundaries and regional cooperation is of greatest importance. As a boost for regional energy market integration, the Council adopted twenty-one infrastructure projects of regional significance, which will also enhance security of energy supply, increase energy efficiency and the uptake of energy from renewable sources. The ministers also agreed to re-open negotiations on amendments to the Treaty establishing the Energy Community which, once adopted, will help enhance market integration between Energy Contracting Parties and EU Member States.

Joint Energy Community Secretariat - EBRD event explores establishment of a Ukrainian gas exchange

On 19 November in Kyiv, foreign and Ukrainian stakeholders, including exchanges, transmission system operators, traders, regulators, government representatives and international financial organizations, gathered together to discuss the establishment of a gas exchange in Ukraine. The participants endorsed a gas exchange implementation roadmap, which foresees the establishment of a fully functional gas exchange with clearing services, as well as a blueprint of what a Ukrainian gas exchange could look like and the key steps needed to get there, developed with the support of the European Bank for Reconstruction and Development (EBRD) and the Energy Community Secretariat. The next stage of the process will be the formalisation of the cooperation between Ukrainian authorities, EBRD and the Secretariat.

Draft methodology for calculating tariffs for ancillary services presented under EU4Energy

On 20 November 2018, the draft methodology for calculating tariffs for ancillary services such as voltage control and black start that might be procured under a regulated process, if needed for a transitional period, was presented to the National Energy and Utilities Regulatory Commission (NEURC) and state enterprise NPC “Ukrenergo” in Ukraine under the framework of EU4Energy technical assistance. The new methodology will ensure efficient cost allocation in the procurement of ancillary services and effective functioning of electricity markets.

EU4Energy to assist Georgia in developing energy performance of buildings calculation methodology

On 15 November, the first meeting of the working group created in cooperation with the Ministry of Economy and Sustainable Development of Georgia, aimed at developing the draft methodology for calculation of energy performance of buildings (EBP), took place in Tbilisi. Experts provided comments to the first draft document and engaged in active discussions and reviews of the terms and definitions used in the methodology as well as the calculation details and normative references that are indispensable for the application of the methodology.

Joint Energy Community – IRENA workshop prepares Contracting Parties for grid integration of variable renewables

Today’s workshop organized jointly by the Energy Community and the International Renewable Energy Agency (IRENA) was able to capture the key challenges and opportunities linked with the grid integration of variable renewable energy sources, like wind or solar. The workshop identified the current and future energy trends, concluding that a complete transformation of the power sector is inevitable with the expected large-scale deployment of renewables. Coordinated early planning for a system with a higher share of renewable energy could avoid making costly investment mistakes.

Secretariat’s Implementation Report 2018: Energy Community has to step up efforts to prepare for the clean energy transition

The Energy Community Secretariat’s Annual Implementation Report, released today, underlines that the Energy Community Contracting Parties have made progress in reforming their energy sectors, but upgraded efforts are needed. This is especially important if the clean energy transition is to succeed in the Energy Community. The Report, which was revamped to provide an even more accurate snapshot of the progress achieved by the Contracting Parties, concludes that the average implementation score is at around 43%. For the first time, the report comprises all nine Energy Community Contracting Parties, including the newest member Georgia.

Secretariat invites interested parties to send observations on the exemption decision for the Gastrans natural gas pipeline project

The Serbian energy regulatory authority (AERS) in its decision of 1 October 2018 granted an exemption to Gastrans d.o.o. for its natural gas pipeline project from the obligation of third party access rules, regulated tariffs and ownership unbundling. The pipeline is planned to span from the Bulgarian-Serbian border to the Serbian-Hungarian border including exit points to the Serbian system. AERS submitted its exemption decision to the Secretariat, which is currently preparing an Opinion on the decision.

Energy Community hosts second meeting of External Contact Platform to develop cooperation with ENTSOG

Lower wholesale energy prices translate into lower retail prices for the second year in a row

Average energy retail prices for households in the EU decreased in 2017, reflecting for the second consecutive year the decline of energy wholesale prices in preceding years, also thanks to market integration. However, the non-contestable part of the bill (network costs, taxes, levies and other charges) continued to increase. Some of the non-contestable components of the bill have supported the development of renewable energies, which are key for the EU to fulfil the objectives of the Paris agreement against climate change.

Secretariat submits comments to the European Commission regarding Transgaz’ proposed anti-trust commitments

In June 2017, the European Commission opened proceedings against Transgaz, the manager and operator of the national gas transmission network in Romania, for potential breach of EU competition rules as regards the flow of natural gas from Romania to other Member States, in particular Hungary and Bulgaria (Case AT.40335 – Romanian gas interconnectors). In September 2018, Transgaz offered commitments pursuant to Article 9 of Regulation (EC) No 1/2003 to meet the competition concerns raised by the Commission. The commitments concern an increase of export capacities at the interconnection points with Hungary and Bulgaria, non-discrimination between export and domestic tariffs, and generally any other anti-competitive conduct. In order to test whether these commitments effectively remove the competitive concerns, the European Commission invited interested parties to submit their observations on the proposed commitments of Transgaz.

The Executive Board discussed initial projects with the aim to establish a network of alumni of the Energy Community Summer School.

On 27 September 2018, the Serbian parliament approved the removal of the destination clause included in the 2012 inter-governmental agreement between the government of the Republic of Serbia and the government of the Russian Federation for the supply of natural gas. This agreement provided that the gas supplied on its basis is intended for use in the Serbian market only, thereby restricting the territory to which the Serbian buyer can sell the gas. Such destination clause constitutes a violation of Energy Community competition law.

Secretariat welcomes launch of residential energy efficiency programme in Serbia under REEP Plus

On 26 September, the European Bank for Reconstruction and Development (EBRD) officially launched the start of a new Green Economy Financing Facility (GEFF) for Serbia that will provide loans to households for energy efficiency improvements. WB6 Initiative continues efforts to create a regional electricity market

Secretariat’s Dispute Resolution Centre brings results in gas transmission code dispute

Transposition of Oil Stocks Directive remains key priority concludes 10th Energy Community Oil Forum

Formally opened by Aleksandar Antic, Minister of Mining and Energy of Serbia, the 10th Energy Community Oil Forum took place on 25 September in Belgrade. The Forum stressed the importance of timely transposition of the Oil Stocks Directive in order to ensure its full implementation by the 2022 deadline. The Forum acknowledged that this would require significant efforts by the majority of Contracting Parties, which are yet to decide and legislate the most appropriate oil stockholding model.  Only Serbia has transposed the Directive and started its implementation.

Energy Community Secretariat reviews amendments to the gas transmission tariff methodology of Ukraine

The Energy Community Secretariat undertook a review of the amendments to the gas transmission tariff methodology published for consultation by the national energy regulatory authority of Ukraine, NEURC. The Secretariat broadly welcomes the proposal as another step towards increasing transparency of tariff setting, whilst reinforcing non-discrimination among system users. The great majority of proposed changes relate to tariff design and, more specifically, the number of entry and exit points and mechanisms for allocation of allowed revenue to these points.

The Energy Community Secretariat’s Dispute Resolution and Negotiation Centre mediates dispute in the Albanian hydro sector

The Energy Community Secretariat’s Dispute Resolution and Negotiation Centre has been called upon to mediate a dispute regarding balancing issues in the Albanian hydro sector. The parties to the mediation are the Ministry of Infrastructure and Energy of Albania and the privately-owned Energji Ashta hydro power plant.  The dispute arose between KESH (the largest electricity producer in Albania) and HPP Energji Ashta, and it involves other Albanian state-owned stakeholders: ERE (the energy regulator in Albania), OSHEE (the Albanian distribution system operator) and OST (the Albanian transmission system operator). Mr Dirk Buschle has been appointed as Mediator, and he is supported by Ms Rozeta Karova and Mr Arben  Kllokoqi. The first meetings with the parties and all other entities involved have already taken place.

EU4Energy fosters discussion on cross-border trading mechanisms in Ukraine

Secretariat participates in the first meeting of the Dniester Commission

Yesterday, Deputy Director Dirk Buschle and Senior Environmental Expert Peter Vajda participated in the inaugural meeting of the Commission for Sustainable Use and Protection of the Dniester River Basin in Chisinau, Moldova. The Commission was set up under the Dniester River Basin Agreement between Moldova and Ukraine, two Contracting Parties to the Energy Community Treaty. The Secretariat’s focus in working with the Commission will be on environmental issues related to the operation of existing as well as the construction of new hydropower plants on the Dniester river, and to help ensuring compliance with the acquis communautaire in this respect.

EU4Energy to help tackle emissions caused by incineration and co-incineration of waste in Ukraine

On 18 September 2018, EU4Energy launched a technical assistance project to support Ukraine with its obligations under the environmental dimension of the Energy Community Treaty. In cooperation with the Ministry of Environment and Natural Resources of Ukraine, the Energy Community Secretariat will assist the development of draft legislation in the field of industrial emissions, as set out by Directive 2010/75/EU. This is to be achieved through the application of operational conditions, technical requirements, and emission limit values for waste incineration and co-incineration plants. The draft legislation will be developed by the end of the year.

Unbundling of Naftogaz continues to be of concern

Energy Community prepares for implementation of network code on harmonised transmission tariff structures for gas

Unbundling of Naftogaz in line with the Third Energy Package – Recent Press Releases

A Naftogaz press release earlier this week reported that the supervisory boards of Naftogaz and of Mahistralny Gazoprovody Ukrainy (MGU) had agreed on a Memorandum of Understanding concerning the unbundling of gas transmission in Ukraine. In response to media requests, the Secretariat would like to clarify that it had not been consulted on the final version of such a document. During the last meeting of the Energy Reform Coordination Council, chaired by Prime Minister Groysmann, it has been agreed that the Secretariat and NEURC (the Ukrainian regulator) are involved to ensure that the model and actions agreed upon can result in certification of the transmission system operator. It is important that the designated authorities, and ultimately the Government, take responsibility of the unbundling process rather than delegating it to the supervisory boards of two companies. Accountability and transparency will be crucial not only in rectifying the breach of the Energy Community rules on unbundling, but also to create certainty and reliability for domestic and international partners.

Secretariat initiates case on failure to ensure third party access on Hungary-Serbia gas interconnector

Today, the Secretariat sent an Opening Letter to the Republic of Serbia in Case ECS-13/17. The Secretariat takes the preliminary view that by the continuous failure to ensure unrestricted non-discriminatory third party access to the Horgoš interconnection point on the border between Serbia and Hungary, the Republic of Serbia fails to comply with the obligations under the Energy Community acquis for ensuring non-discriminatory third party access to the natural gas transmission system. In particular, the Secretariat raised concerns regarding Serbia’s failure to ensure the application of objective, non-discriminatory capacity allocation measures and published and transparent tariffs for system access, as well as by failure to ensure competitive market conduct of gas incumbent Srbijagas concerning access to its operated natural gas transmission system.

Secretariat extends the grounds for non-compliance of Ukraine’s public service obligation scheme in the gas sector

Energy Community priority gas infrastructure project between Bosnia and Herzegovina and Croatia receives major boost

An EU funded study, realized with the support and active engagement of the Energy Community Secretariat, has confirmed the financial viability of the south gas interconnector between Bosnia and Herzegovina and Croatia. This is an important step towards the realisation of the interconnector, the aim of which is to establish a new supply route for Bosnia and Herzegovina resulting in diversified and reliable natural gas supply and to guarantee the security of supply of the Federation, one of the country’s entities. The project is planned to be commissioned by 2023. The gas interconnector (Gas_03) received the status of Energy Community Project of Mutual Interest (PMI) in 2016.

Secretariat opens dispute settlement procedure against Serbia for breach of Third Energy Package unbundling rules

On 3 July, the Energy Community Secretariat initiated an ex officio preliminary dispute settlement procedure against Serbia for breaching the unbundling and certification rules of the Third Energy Package in the gas sector.  In its Opening Letter, the Secretariat takes the view that by certifying Yugorosgaz-Transport under the independent system operator (ISO) model without fulfilling the corresponding obligations regarding unbundling, Serbia fails to comply with its obligations under the Energy Community Treaty.

Secretariat opens dispute settlement procedure against Kosovo* for lack of transposition of emissions control legislation

On 2 July, the Energy Community Secretariat initiated an ex officio preliminary dispute settlement procedure against Kosovo* for the lack of transposition and implementation of legislation related to the emissions of large combustion plants.  In its Opening Letter, the Secretariat takes the view that the national environmental legislation of Kosovo* aiming to curb emissions into the air fails to comply with the obligations under the Energy Community Treaty by not fully transposing the limit values of sulphur dioxide, nitrogen oxides and dust for existing plants, as stipulated in the Large Combustion Plants Directive. Furthermore, the Secretariat also considers that the rules for new plants have not been brought in line with the requirements of the Industrial Emissions Directive.

Energy Community Dispute Settlement: Key decisions in the lead up to the Ministerial Council

On 22 June 2018, three Reasoned Requests were submitted to the Ministerial Council for a decision under Article 91 of the Energy Community Treaty. The later concern the lack of transposition and notification of transposition measures to the Secretariat regarding Regulation (EU) 347/2013 on guidelines for trans-European energy infrastructure by Albania (Case ECS-2/18), Bosnia and Herzegovina (Case ECS-3/18) and Ukraine (Case ECS-4/18).

Informal Ministerial Council discusses 2030 energy and climate targets

The second joint meeting of Ministers responsible for energy, environment and climate policy took place on 22-24 June 2018, in Dürnstein (Wachau, Austria). The meeting put a focus on establishing 2030 targets for energy efficiency, renewables and greenhouse gas emissions reduction in the Energy Community. The meeting was opened by speeches from Josef Plank, General Secretary, Federal Ministry for Sustainability and Tourism of Austria, and Laurence Tubiana, CEO of European Climate Foundation.

Sustainability Forum points to solutions to accelerate the clean energy transition in the Energy Community

Secretariat issues guidance on preparation of National Energy and Climate Plans in the Energy Community

The Secretariat has published Policy Guidelines aimed at assisting the Contracting Parties in the process of developing integrated National Energy and Climate Plans (NECPs). The NECPs provide a streamlined framework for the Contracting Parties to plan their climate and energy objectives, targets and policies in an integrated manner. The adoption of the NECPs follows a non-binging Recommendation adopted by the Energy Community Ministerial Council in December 2017. As noted in the Recommendation, the preparation of the NECPs should start already in 2018.

Athens Forum calls on all stakeholders to establish day ahead markets by mid-2019

Secretariat supports development of climate change legislation in Kosovo*

As announced during the Sustainable Development Week earlier this week in Pristina, the Secretariat submitted to the Kosovo* ministry of environment a draft new law on climate change.  This new law would be transposing Regulation (EU) No 525/2013 on a mechanism for monitoring and reporting greenhouse gas emissions and the Recommendation of the Ministerial Council of the Energy Community on preparing for the development of integrated national energy and climate plans. The Secretariat expects discussions at technical level on this draft in the coming months.

Secretariat works to improve electricity network tariff setting methodology in Ukraine

In close cooperation with the National Energy and Utilities Regulatory Commission (NEURC) of Ukraine, the Secretariat developed a set of recommendations to align the RAB methodology with the Energy Community acquis.

Parliament of former Yugoslav Republic of Macedonia adopts Third Energy Package compliant Energy Law

On 21 May 2018, the Macedonian Parliament adopted an Energy Law transposing the Third Energy Package. Following the adoption of the law, this Contracting Party formally rectified the breaches established by the Ministerial Council in cases ECS-09/16 and ECS-02/15. Therefore, the Secretariat formally closed cases ECS-09/16S and ECS-02/15 S and withdrew the Reasoned Requests submitted to the Ministerial Council for decisions under Article 92 of the Treaty. Former Yugoslav Republic of Macedonia was the only Contracting Party where small businesses and all household customers were deprived of their right to purchase electricity directly from the supplier of their choice. With the adoption of the new law, eligibility of these customers is ensured.

On 25 - 26 April, members of the Energy Community Distribution System Operators for gas (ECDSO-g) from Georgia, Moldova and Ukraine took part in the High-level Policy Talks on gas distribution aimed at tackling the changes brought forward by the gas market reform. The event was organized under the framework of the EU4Energy Governance project. Representatives of the EU Delegation in Vienna, the Parliament and the Regulatory Authority of Ukraine, Eurogas and Energy Community experts shared best practices to support the countries in the implementation of their obligations under the Energy Community Treaty. The meeting was primarily focussed on the measurement of delivered gas and unbundling, as requested in previous meetings of the Energy Community Coordination Platform of gas distribution system operators.

EBRD launches energy efficiency programme in former Yugoslav Republic of Macedonia

Armenian competition authority joins Energy Community Competition Network

On 20 April 2018, Mr Pavel Ghaltakhchyan, Deputy Chairman of the State Commission for the Protection of Economic Competition of the Republic of Armenia, and Ms Marie-Therese Richter, Energy Lawyer at the Secretariat, signed the Joint Declaration on the establishment of an Energy Community Competition Network. Workshop to outline perspectives for the future of gas in the Western Balkans

on 17 April 2018

An event focusing on gas infrastructure projects in the Western Balkans has been long awaited by the stakeholder community. Due to the lack of infrastructure, gas remains an untapped energy source in the Western Balkans. Serbia is the only country with a significant level of gas penetration, former Yugoslav Republic of Macedonia and Bosnia and Herzegovina are gasified partially, whilst Albania, Kosovo* and Montenegro do not have a gas market for now. All the Western Balkan countries have significant gas infrastructure development plans, some driven by improving security of supply, others by potential gas source diversification or mere creation of gas networks.

EU4Energy presents electricity supply rules to beneficiaries in Georgia

On 17 April, experts of the Energy Community Secretariat presented to the National Energy and Water Supply Regulatory Commission (GNERC) and distribution system operators in Georgia the draft rules for electricity supply developed under the framework of the EU4Energy project.

The adoption of the rules is a necessary part of the electricity market reform process and is important for retail market opening and harmonization of electricity market rules with the EU Third Energy Package.

Operational rules and standard contract terms will regulate the activities of universal suppliers and the supplier of last resort, with a view to ensuring a continuous, reliable and high quality supply of electricity to households and small businesses, in line with the relevant provisions of the draft Energy Law.

During the discussion, it was underlined that the draft operational rules constitute an essential element of the overall legislative reforms and need to be aligned with other market rules, including on the distribution network code and supplier switching.

Former Yugoslav Republic of Macedonia and Bulgaria sign Memorandum on day-ahead electricity market coupling under auspices of WB6 energy connectivity initiative

The Transmission System Operator and Energy Regulatory Commission of former Yugoslav Republic of Macedonia together with the Independent Energy Exchange and Electricity System Operator of Bulgaria signed a Memorandum of Understanding on the coupling of the two countries’ day-ahead electricity markets at a stakeholder meeting on 12 April held under the auspices of the WB6 energy connectivity initiative facilitated by the Secretariat. The Memorandum is expected to be signed also by the Bulgarian Energy and Water Regulatory Commission.

WB6 Sustainability Report marks progress but calls for increased political support

The Secretariat’s WB6 report on sustainability finds that progress in a number of measures has been achieved by governments, although more political support is needed to make full use of existing programmes, accelerate the clean energy transition and deliver on the region’s climate commitments. The 3rd Energy Efficiency Action Plans have now been adopted by all the WB6 and progress was achieved also in transposing the Energy Performance of Buildings Directive. On support schemes for renewables, there is an ongoing discussion in many Contracting Parties on how to shift from feed-in tariff to a more competitive, market-based bidding process along with an increasing consideration for the future role of independent power producers and community energy.

EU4ENERGY High-level Policy Talks in Georgia highlight opportunities of EU gas market reforms

As set in its Energy Community Accession Protocol, Georgia has committed to implementing flagship EU legislation in the area of natural gas in less than two years from now. The so-called “EU Third Energy Package” will induce restructuring of the gas sector, opening it to competition, as well as introduce consumer benefits. Understanding that a smooth transition towards the new market framework requires effective and rigorous stakeholder engagement, the EU4Energy Governance* project implemented by the Energy Community Secretariat organized a two-day event focused on supporting natural gas market reforms in Georgia. The High-level Policy Talks brought together representatives of the government, natural gas market participants and civil society.

Secretariat issues Policy Recommendations to help Belarus reform its energy sector

Today, the Secretariat published policy recommendations aimed at assisting Belarus to design and implement effective reform measures in its energy sectors in line with best European and Energy Community practices. The report assesses the legal framework of Belarus against the Energy Community Treaty in the areas of electricity, gas, oil, renewables and competition, whilst taking into account the country’s present and future obligations under the Eurasian Economic Union. The Secretariat stands ready to assist Belarus in related policy reforms should such assistance be requested, as it has already done in the electricity sector by drafting an Electricity Market Law.

Secretariat publishes Policy Guidelines to unify distribution network tariff regulation

The acquis requires regulatory authorities to ensure that network tariffs are transparent, cost-reflective and allow for the necessary investment in networks. Tariffs shall also provide to system operators short- and long-term incentives to increase efficiency, foster market integration as well as security of supply. These principles are interpreted very differently and practice in this area is extremely diverse.

Procurement of electricity in Moldova needs serious improvement

The 2018 procurement of electricity in Moldova ended with the win of the state-owned company Energocom, with a final price of 52.8 USD/MWh (average). In spite of clear guidelines proposed by the Secretariat and adopted by the Ministry of Economy and Infrastructure, little progress was made compared to last year. Most importantly, the Ministry actively supported the interests of Energocom, especially in the last stages of the procedure. The 2018 procurement procedure also raised suspicions regarding a possible concerted action between Enercogom, MGRES and DTEK – as the last two companies decided to negotiate directly with the state-owned company Energocom outside the formal procedure.

EU4Energy launches discussions to facilitate energy efficiency reforms in Moldova

Today, the first High-level Policy Talks on Energy Efficiency in Moldova organized under the auspices of the EU4Energy Governance project*, take place in Chisinau. The event aims to address the state of play of development of the energy efficiency legal framework in Moldova, targets prescribed under the Energy Efficiency Directive, strengthening institutions dealing with energy efficiency and adoption of the draft Energy Efficiency Law. Experts of the Energy Community Secretariat will share their knowledge and expertise to support the Moldovan authorities with the fulfilment of their commitments under the Energy Community Treaty. The event brings together key stakeholders, including representatives of government, parliament, industry, international financial institutions and civil society.

Latest WB6 electricity monitoring report shows stagnation

The Secretariat’s WB6 report on electricity points to limited progress achieved by the Contracting Parties during the latest monitoring period despite the renewed interest in the implementation of regional solutions for day-ahead market processes and coupling. Further implementation of the connectivity reform measures largely depends on major institutional changes at the national level. Foremost, this includes finalising the unbundling of transmission and distribution system operators and appointing day-ahead market operators. The lack of progress is also notable with respect to wholesale and retail market opening.

Secretariat to cooperate with European Environment Agency on reporting of emissions from large combustion plants

On 1 January 2018, the implementation phase of Directive 2001/80/EC regulating the emissions of large combustion plants started in the Energy Community. This means that fossil fuel firing power plants have to reduce their emissions of sulphur dioxide, nitrogen oxides and dust significantly. The directive also requires that operators as well as the Contracting Parties monitor the emissions of these pollutants and report those to the Secretariat.

Secretariat escalates case on Ukrainian capacity allocation auction rules and their application for transit

Today, the Energy Community Secretariat sent a Reasoned Opinion to Ukraine for its non-compliance with the rules on allocation of cross-border capacity and their application for transit, as the next step in the dispute settlement case. The present system in Ukraine does not allow for commercial transit of electricity to and from other Parties to the Energy Community Treaty. Instead, only one state-owned energy undertaking is given right to use cross-border capacities for transit. This constitutes an obstacle to the establishment of a pan-European electricity market.

Secretariat assesses Moldovan regulator’s distribution tariff methodology as in line with the acquis and European best practices

On 9 March 2018, the Moldovan regulator (ANRE) published an electricity distribution tariff methodology for 2018-2023 in the Official Journal. This methodology will replace the previous one, which is subject to an infringement procedure in Case ECS-9/17. During the drafting process, the Secretariat and an international tariff expert funded by the EU ensured compliance with the Energy Community acquis and European best practices. Today, the Secretariat, upon invitation by the International Monetary Fund, assessed the final methodology as compliant. If properly applied, the new methodology will be a key element for stability in Moldova’s electricity sector and regaining investors’ trust.

Secretariat notes improvement in the Moldovan regulator’s independence and performance

Today, the Secretariat published an update of its 2016 review of the Moldovan national regulatory authority’s (ANRE) independence and performance. The Secretariat notes that the appointment of the new director general was made in a more transparent and neutral procedure than in the past.  Moreover, Moldova’s legal framework broadly complies with the Third Energy Package, albeit with a few notable exceptions which require remedy. For example, the 2016 Electricity Law contains rules on how losses incurred by distribution system operators are calculated, thus impeding the autonomy and independence of ANRE when designing tariff methodologies.

Energy Community steps up cooperation with Mediterranean countries

The Energy Community Regulatory Board (ECRB) and Mediterranean Energy Regulators (MedReg) agreed to step up cooperation at a recent meeting hosted by the Energy Community Secretariat. The meeting was attended by the national regulators of the Energy Community Contracting Parties as well as the MedReg regulatory members of Jordan, Malta, Spain, Italy, Palestine and Lebanon. Cooperation between ECRB and MedReg is well established since 2014 and reflects the need to align the legal framework for interconnected markets not least because of the overlapping membership between the two organizations.

Georgia rapidly prepared for transposition of Oil Stocks Directive

Once again, the newsletter puts energy developments of significance for both Energy Community Contracting Parties and EU Member States in the spotlight. Increasing the sustainable use of biomass could bring significant benefits to the Western Balkans

Increasing the sustainable and efficient use of biomass could enhance energy security and reduce greenhouse gas emissions and local air pollution in the Western Balkans, whilst helping the countries to meet their 2020 renewable energy targets cost-effectively. Yet, significant financing needs to be mobilized to exploit the economic opportunities to increase biomass use and make existing use more efficient, concludes a study published by the World Bank in collaboration with the Energy Community Secretariat, and financed by the EU through the Western Balkans Investment Framework.

Albania must continue with energy sector reforms - Director

During his visit to Tirana today, Director Kopač met with key Albanian energy sector stakeholders to take stock of achieved reforms and the priorities ahead. Starting with a presentation in the Parliament of Albania hosted by the Committee on Productive Activity, Trade and Environment, Mr Kopač acknowledged the progress made by Albania thus far, but stressed that reforms must continue apace in order for the country’s energy consumers to truly benefit from the changes. The country should take steps towards establishing a fully competitive wholesale and retail electricity market. Moreover, the creation of a national power exchange, whose establishment is in delay, would be a real game changer not just for Albania, but also for the region.

Secretariat discusses gas sector reforms with head of Ukrainian regulatory authority

Today, the Secretariat met with the Chairman of National Energy and Utilities Regulatory Commission (NEURC), Mr Dmitro Vovk, at its seat in Vienna. The meeting took stock of the Secretariat’s ongoing assessment of the legal framework and de facto performance of the Ukrainian regulator. The meeting also served to discuss the draft methodology for gas distribution tariffs and draft public service obligation (PSO) act in the gas sector.

Energy Community adopts first set of Third Energy Package Network Codes and Guidelines

The Energy Community Permanent High Level Group has formally adopted two new pieces of acquis in gas and three in electricity. “I am delighted that Third Energy Package Network Codes and Guidelines will now become part of the Energy Community legal framework”, Director Kopač underlined. “These legal acts complement the existing gas and electricity acquis and will allow our countries to keep pace with European developments. Together with additional Network Codes and Guidelines yet to be adopted in the Energy Community, they constitute an essential element for the efficient functioning of the pan-European energy market, which puts energy consumers at the forefront”, he added.

Secretariat opens dispute settlement procedures against Albania, Bosnia Herzegovina and Ukraine for lack of unbundling of electricity distribution operators

The Energy Community Secretariat initiated ex officio preliminary dispute settlement procedures against Albania, Bosnia Herzegovina and Ukraine for the lack of unbundling of the countries’ electricity distribution system operators. In its Opening Letters, the Secretariat takes the view that the three Contracting Parties fail to comply with their obligations under the Energy Community Treaty by (completely, partly or incorrectly) not having transposed the unbundling requirements of the Third Energy Package into national legislation and not having taken measures to implement legal and functional unbundling of their national electricity distribution system operators in practice. The electricity distribution system operators of the three countries still have fully integrated legal and functional governance structures for electricity distribution and supply.

Integrated National Energy and Climate Plans in the Energy Community

ECRB elects new President and sets priorities for 2018

At its recent session, the Energy Community Regulatory Board (ECRB) elected Mr Giorgi Pangani as its President for the years 2018 and 2019. A lawyer by profession, Mr Pangani is working for the Georgian National Energy and Water Supply Regulatory Commission since 2010. Becoming Commissioner in 2015, his current responsibilities include transposition of the Energy Community acquis communautaire into Georgian legislation and stakeholder coordination. “I am honoured by the confidence my ECRB colleagues have placed in me”, the newly elected President underlined. “I am very much looking forward to continuing our excellent cooperation on regulatory issues of regional significance. Building on the expertise and experience established over the past years, I trust that, together, we can make the ECRB even stronger”, he added.

Regional projects for market coupling and cross-border balancing in the Western Balkans are kicked-off

On 19 and 20 December, regional projects for technical assistance to support day-ahead market coupling and cross-border balancing in the Western Balkans were kicked-off at meetings held under the Western Balkan 6 Initiative in Vienna. The objective of the technical assistance implemented by the Energy Community Secretariat is to assist the WB6 and neighbouring EU transmission system operators, national regulatory authorities and power exchanges in the preparation and implementation of market coupling projects and platforms for cross-border balancing cooperation. The projects are expected to be finalised by end 2018 as agreed under the Western Balkan 6 Memorandum of Understanding (WB6 MoU).

Unlawful destination clause in intergovernmental agreement on gas supply between Serbia and Russia to be dropped

According to media reports, the Presidents of Serbia and Russia have agreed to exclude a destination clause from the 2012 Intergovernmental Agreement on the supply of natural gas to Serbia. The compliance of the destination clause with European competition law was challenged by the Energy Community Secretariat in infringement Case-18/16 by the Secretariat.

Parliamentary Plenum adopts report highlighting importance of cross-border cooperation and acquis implementation to enhance security of energy supply

Yesterday, the Energy Community Parliamentary Plenum adopted the first ever report, the focus of which was security of energy supply. The report was co-drafted by Mr Lev Pidlisetskyi, Member of the Ukrainian Parliament, and Mr Claude Turmes, Member of the European Parliament. Efficient cross-border cooperation among Contracting Parties as well as EU Member States and complete compliance with the acquis was deemed essential for successfully ensuring security of energy supply. The plenum also expressed concerns regarding the outdated legislation on security of gas and electricity supply currently applicable in the Energy Community.

15th Ministerial Council Sets Vision for Post-2020 Climate and Energy Policy in the Energy Community

Convening under the Kosovo Presidency in Pristina today, the Energy Community Ministerial Council embarked on a process aimed at setting targets for renewable energy, energy efficiency and greenhouse gas emission reduction for 2030 in the Energy Community. The Contracting Parties will be supported by guidelines for the preparation of integrated National Energy and Climate Plans, adapted to fit the specificities of the Contracting Parties and soon to be presented by the Secretariat to the Community’s Energy and Climate Committee. The new mechanism will ensure a robust framework for streamlined reporting and transparent implementation of energy and climate policies. Individual Contracting Parties, such as Albania, expressed their willingness to integrate their energy and climate planning already now.

Secretariat decides not to initiate cases after successful mediation at the Energy Community Dispute Resolution and Negotiation Centre

In July 2017, the Secretariat and the authorities of Bosnia and Herzegovina signed a Settlement Agreement regarding the environmental permits of two planned large combustion plants (TPP Banovici and TPP Tuzla 7). The environmental permits were the subject of cases ECS-16/16 and ECS-17/16 against Bosnia and Herzegovina regarding incompliance with Energy Community acquis.

Secretariat kicks off the first Energy Community Regulatory School training

Today, the first training organised under the umbrella of the Energy Community Regulatory School, bringing together participants from 8 Energy Community Contracting Parties, took place at the Secretariat’s premises in Vienna. The new initiative aims to provide targeted support to Energy Community regulators in the light of the continuous need to broaden their expertise in order to ensure pro-active and effective regulation of energy markets. This is especially important given the new pieces of Energy Community acquis communautaire such as gas and electricity network codes and guidelines or the Regulation on Wholesale Energy Market Integrity and Transparency (REMIT).

Montenegro’s RAE becomes first Energy Community regulator to join ACER working groups
