EBRD launches energy efficiency programme in former Yugoslav Republic of Macedonia

Today, the European Bank for Reconstruction and Development (EBRD) launched a Green Economy Financing Facility (GEFF) in former Yugoslav Republic of Macedonia that will provide loans to households for energy efficiency improvements in the residential sector. The facility was established with the support of the Energy Community Secretariat.

Armenian competition authority joins Energy Community Competition Network

on 23 April 2018

On 20 April 2018, Mr Pavel Ghaltakhchyan, Deputy Chairman of the State Commission for the Protection of Economic Competition of the Republic of Armenia, and Ms Marie-Therese Richter, Energy Lawyer at the Secretariat, signed the Joint Declaration on the establishment of an Energy Community Competition Network. This makes Armenia the first Observer to join the Network.

ENTSOG hosts first meeting of External Contact Platform to develop cooperation with Energy Community TSOs and other non-EU Gas Transmission Companies

Workshop to outline perspectives for the future of gas in the Western Balkans

on 17 April 2018

An event focusing on gas infrastructure projects in the Western Balkans has been long awaited by the stakeholder community. Due to the lack of infrastructure, gas remains an untapped energy source in the Western Balkans. Serbia is the only country with a significant level of gas penetration, former Yugoslav Republic of Macedonia and Bosnia and Herzegovina are gasified partially, whilst Albania, Kosovo* and Montenegro do not have a gas market for now. All the Western Balkan countries have significant gas infrastructure development plans, some driven by improving security of supply, others by potential gas source diversification or mere creation of gas networks.

EU4Energy presents electricity supply rules to beneficiaries in Georgia

On 17 April, experts of the Energy Community Secretariat presented to the National Energy and Water Supply Regulatory Commission (GNERC) and distribution system operators in Georgia the draft rules for electricity supply developed under the framework of the EU4Energy project.

The adoption of the rules is a necessary part of the electricity market reform process and is important for retail market opening and harmonization of electricity market rules with the EU Third Energy Package.

Operational rules and standard contract terms will regulate the activities of universal suppliers and the supplier of last resort, with a view to ensuring a continuous, reliable and high quality supply of electricity to households and small businesses, in line with the relevant provisions of the draft Energy Law.

During the discussion, it was underlined that the draft operational rules constitute an essential element of the overall legislative reforms and need to be aligned with other market rules, including on the distribution network code and supplier switching.

Former Yugoslav Republic of Macedonia and Bulgaria sign Memorandum on day-ahead electricity market coupling under auspices of WB6 energy connectivity initiative

The Transmission System Operator and Energy Regulatory Commission of former Yugoslav Republic of Macedonia together with the Independent Energy Exchange and Electricity System Operator of Bulgaria signed a Memorandum of Understanding on the coupling of the two countries’ day-ahead electricity markets at a stakeholder meeting on 12 April held under the auspices of the WB6 energy connectivity initiative facilitated by the Secretariat. The Memorandum is expected to be signed also by the Bulgarian Energy and Water Regulatory Commission.

WB6 Sustainability Report marks progress but calls for increased political support

on 13 April 2018

The Secretariat’s WB6 report on sustainability finds that progress in a number of measures has been achieved by governments, although more political support is needed to make full use of existing programmes, accelerate the clean energy transition and deliver on the region’s climate commitments. The 3rd Energy Efficiency Action Plans have now been adopted by all the WB6 and progress was achieved also in transposing the Energy Performance of Buildings Directive. On support schemes for renewables, there is an ongoing discussion in many Contracting Parties on how to shift from feed-in tariff to a more competitive, market-based bidding process along with an increasing consideration for the future role of independent power producers and community energy.

EU4ENERGY High-level Policy Talks in Georgia highlight opportunities of EU gas market reforms

As set in its Energy Community Accession Protocol, Georgia has committed to implementing flagship EU legislation in the area of natural gas in less than two years from now. The so-called “EU Third Energy Package” will induce restructuring of the gas sector, opening it to competition, as well as introduce consumer benefits. Understanding that a smooth transition towards the new market framework requires effective and rigorous stakeholder engagement, the EU4Energy Governance* project implemented by the Energy Community Secretariat organized a two-day event focused on supporting natural gas market reforms in Georgia. The High-level Policy Talks brought together representatives of the government, natural gas market participants and civil society.

Secretariat assists the Albanian State Aid Commission

The Albanian State Aid Commission has recently adopted a decision assessing a guarantee given by the Government of Albania to a loan provided by KfW to the transmission system operator (OST) for the “400 kv Albania-Macedonia transmission line Fier-Elbasan-Qafthana”.

Secretariat issues Policy Recommendations to help Belarus reform its energy sector

Today, the Secretariat published policy recommendations aimed at assisting Belarus to design and implement effective reform measures in its energy sectors in line with best European and Energy Community practices. The report assesses the legal framework of Belarus against the Energy Community Treaty in the areas of electricity, gas, oil, renewables and competition, whilst taking into account the country’s present and future obligations under the Eurasian Economic Union. The Secretariat stands ready to assist Belarus in related policy reforms should such assistance be requested, as it has already done in the electricity sector by drafting an Electricity Market Law.

Secretariat launches public consultation on potential priority infrastructure projects in line with TEN–E Regulation

Today, the Secretariat launched a public consultation to gather views on the selection of priority infrastructure projects in line with EU Regulation 347/2013 on guidelines for trans-European energy infrastructure, as adapted for the Energy Community. The projects, in the areas of electricity, gas or oil, have been submitted in an open call by project promoters as potential priority infrastructure projects in line with the TEN-E Regulation.

Secretariat publishes Policy Guidelines to unify distribution network tariff regulation

The acquis requires regulatory authorities to ensure that network tariffs are transparent, cost-reflective and allow for the necessary investment in networks. Tariffs shall also provide to system operators short- and long-term incentives to increase efficiency, foster market integration as well as security of supply. These principles are interpreted very differently and practice in this area is extremely diverse.

Procurement of electricity in Moldova needs serious improvement

The 2018 procurement of electricity in Moldova ended with the win of the state-owned company Energocom, with a final price of 52.8 USD/MWh (average). In spite of clear guidelines proposed by the Secretariat and adopted by the Ministry of Economy and Infrastructure, little progress was made compared to last year. Most importantly, the Ministry actively supported the interests of Energocom, especially in the last stages of the procedure. The 2018 procurement procedure also raised suspicions regarding a possible concerted action between Enercogom, MGRES and DTEK – as the last two companies decided to negotiate directly with the state-owned company Energocom outside the formal procedure.

Secretariat convenes IFIs and donors meeting to boost coordination for sustainable development in the Energy Community

EU4Energy launches discussions to facilitate energy efficiency reforms in Moldova

Today, the first High-level Policy Talks on Energy Efficiency in Moldova organized under the auspices of the EU4Energy Governance project*, take place in Chisinau. The event aims to address the state of play of development of the energy efficiency legal framework in Moldova, targets prescribed under the Energy Efficiency Directive, strengthening institutions dealing with energy efficiency and adoption of the draft Energy Efficiency Law. Experts of the Energy Community Secretariat will share their knowledge and expertise to support the Moldovan authorities with the fulfilment of their commitments under the Energy Community Treaty. The event brings together key stakeholders, including representatives of government, parliament, industry, international financial institutions and civil society.

Latest WB6 electricity monitoring report shows stagnation

The Secretariat’s WB6 report on electricity points to limited progress achieved by the Contracting Parties during the latest monitoring period despite the renewed interest in the implementation of regional solutions for day-ahead market processes and coupling. Further implementation of the connectivity reform measures largely depends on major institutional changes at the national level. Foremost, this includes finalising the unbundling of transmission and distribution system operators and appointing day-ahead market operators. The lack of progress is also notable with respect to wholesale and retail market opening.

EBRD and Energy Community Secretariat publish joint Policy Guidelines for renewable energy auctions

Energy and Climate Committee discusses way forward for integrated National Energy and Climate Plans and 2030 targets

The meeting, co-chaired by Connie Hedegaard, Chair of the Board of KR Foundation and former EU Commissioner for Climate Action, and Ostap Semerak, Minister of Ecology and Natural Resources of Ukraine, brought together Ministers, Deputy Ministers and other representatives of Energy Community Contracting Parties and Observer countries countries responsible for climate and energy policy, representatives of the European Commission, the United Nations, IRENA, the German Ministry of Environment, the Austrian Agency for Environment, think tanks, international financial organisations, GIZ and other donors and civil society.

Secretariat expresses concerns about independence of Ukrainian regulatory authority

Today, the Secretariat published its in-depth review of Ukrainian national regulatory authority’s (NEURC) de iure and de facto compliance with the Energy Community acquis. The analysis, requested by the regulator, covers the legal framework as regards the organisational structure, competences and duties of the Board of Commissioners. It also examines the regulator’s genuine independence, professionalism and expertise necessary to perform its duties according to the requirements of the Third Energy Package.

Secretariat to cooperate with European Environment Agency on reporting of emissions from large combustion plants

On 1 January 2018, the implementation phase of Directive 2001/80/EC regulating the emissions of large combustion plants started in the Energy Community. This means that fossil fuel firing power plants have to reduce their emissions of sulphur dioxide, nitrogen oxides and dust significantly. The directive also requires that operators as well as the Contracting Parties monitor the emissions of these pollutants and report those to the Secretariat.

Kosovo* narrowly avoids dispute settlement proceeding for failure to appoint regulatory board members

One day before the scheduled opening of a dispute settlement case by the Secretariat, the Parliament of Kosovo* has appointed two members of the board of the national regulatory authority of Kosovo* (ERO), thus narrowly avoiding the launch of the infringement procedure. The Secretariat has repeatedly expressed its concerns about the country’s failure to have a functioning national regulatory authority in place.

Secretariat escalates case on Ukrainian capacity allocation auction rules and their application for transit

Today, the Energy Community Secretariat sent a Reasoned Opinion to Ukraine for its non-compliance with the rules on allocation of cross-border capacity and their application for transit, as the next step in the dispute settlement case. The present system in Ukraine does not allow for commercial transit of electricity to and from other Parties to the Energy Community Treaty. Instead, only one state-owned energy undertaking is given right to use cross-border capacities for transit. This constitutes an obstacle to the establishment of a pan-European electricity market.

Secretariat assesses Moldovan regulator’s distribution tariff methodology as in line with the acquis and European best practices

On 9 March 2018, the Moldovan regulator (ANRE) published an electricity distribution tariff methodology for 2018-2023 in the Official Journal. This methodology will replace the previous one, which is subject to an infringement procedure in Case ECS-9/17. During the drafting process, the Secretariat and an international tariff expert funded by the EU ensured compliance with the Energy Community acquis and European best practices. Today, the Secretariat, upon invitation by the International Monetary Fund, assessed the final methodology as compliant. If properly applied, the new methodology will be a key element for stability in Moldova’s electricity sector and regaining investors’ trust.

Group of Observers concerned about delayed electricity procurement in Moldova

Secretariat issues Opinion on the certification of the electricity system operator in Montenegro

The Opinion supports the certification of CGES in line with the Preliminary Decision of the Regulatory Energy Agency of Montenegro “RAE”, subject to several remarks.

Secretariat notes improvement in the Moldovan regulator’s independence and performance

Today, the Secretariat published an update of its 2016 review of the Moldovan national regulatory authority’s (ANRE) independence and performance. The Secretariat notes that the appointment of the new director general was made in a more transparent and neutral procedure than in the past.  Moreover, Moldova’s legal framework broadly complies with the Third Energy Package, albeit with a few notable exceptions which require remedy. For example, the 2016 Electricity Law contains rules on how losses incurred by distribution system operators are calculated, thus impeding the autonomy and independence of ANRE when designing tariff methodologies.

Energy Community steps up cooperation with Mediterranean countries

The Energy Community Regulatory Board (ECRB) and Mediterranean Energy Regulators (MedReg) agreed to step up cooperation at a recent meeting hosted by the Energy Community Secretariat. The meeting was attended by the national regulators of the Energy Community Contracting Parties as well as the MedReg regulatory members of Jordan, Malta, Spain, Italy, Palestine and Lebanon. Cooperation between ECRB and MedReg is well established since 2014 and reflects the need to align the legal framework for interconnected markets not least because of the overlapping membership between the two organizations.

As part of its efforts to assist the country in aligning its legislation with the Energy Community oil acquis, the Secretariat provided Georgia a complete package of draft primary and secondary legislation necessary to transpose and implement the Oil Stocks Directive as well as a long term-action plan to guide the establishment of an effective emergency oil stockholding system. All other interested Energy Community Contracting Parties had previously received such assistance, but this is the first time that all legislative acts were delivered by the Secretariat at the same time.

Today, the Secretariat published the third edition of Energy Community Connected - News across the Energy Community Region. Once again, the newsletter puts energy developments of significance for both Energy Community Contracting Parties and EU Member States in the spotlight. This issue provides the latest insights into energy reforms in Ukraine and Moldova and former Yugoslav Republic of Macedonia’s opening towards Bulgaria and Greece. Regional cooperation under the Central and South-Eastern European Energy Connectivity (CESEC) is also assessed, including a new proposal for harmonisation of licensing regimes for the supply of wholesale and final customers in electricity and gas.

Increasing the sustainable use of biomass could bring significant benefits to the Western Balkans

Increasing the sustainable and efficient use of biomass could enhance energy security and reduce greenhouse gas emissions and local air pollution in the Western Balkans, whilst helping the countries to meet their 2020 renewable energy targets cost-effectively. Yet, significant financing needs to be mobilized to exploit the economic opportunities to increase biomass use and make existing use more efficient, concludes a study published by the World Bank in collaboration with the Energy Community Secretariat, and financed by the EU through the Western Balkans Investment Framework.

Albania must continue with energy sector reforms - Director

During his visit to Tirana today, Director Kopač met with key Albanian energy sector stakeholders to take stock of achieved reforms and the priorities ahead. Starting with a presentation in the Parliament of Albania hosted by the Committee on Productive Activity, Trade and Environment, Mr Kopač acknowledged the progress made by Albania thus far, but stressed that reforms must continue apace in order for the country’s energy consumers to truly benefit from the changes. The country should take steps towards establishing a fully competitive wholesale and retail electricity market. Moreover, the creation of a national power exchange, whose establishment is in delay, would be a real game changer not just for Albania, but also for the region.

Energy Community adopts first set of Third Energy Package Network Codes and Guidelines

The Energy Community Permanent High Level Group has formally adopted two new pieces of acquis in gas and three in electricity. “I am delighted that Third Energy Package Network Codes and Guidelines will now become part of the Energy Community legal framework”, Director Kopač underlined. “These legal acts complement the existing gas and electricity acquis and will allow our countries to keep pace with European developments. Together with additional Network Codes and Guidelines yet to be adopted in the Energy Community, they constitute an essential element for the efficient functioning of the pan-European energy market, which puts energy consumers at the forefront”, he added.

Secretariat opens dispute settlement procedures against Albania, Bosnia Herzegovina and Ukraine for lack of unbundling of electricity distribution operators

The Energy Community Secretariat initiated ex officio preliminary dispute settlement procedures against Albania, Bosnia Herzegovina and Ukraine for the lack of unbundling of the countries’ electricity distribution system operators. In its Opening Letters, the Secretariat takes the view that the three Contracting Parties fail to comply with their obligations under the Energy Community Treaty by (completely, partly or incorrectly) not having transposed the unbundling requirements of the Third Energy Package into national legislation and not having taken measures to implement legal and functional unbundling of their national electricity distribution system operators in practice. The electricity distribution system operators of the three countries still have fully integrated legal and functional governance structures for electricity distribution and supply.

ECRB elects new President and sets priorities for 2018

At its recent session, the Energy Community Regulatory Board (ECRB) elected Mr Giorgi Pangani as its President for the years 2018 and 2019. A lawyer by profession, Mr Pangani is working for the Georgian National Energy and Water Supply Regulatory Commission since 2010. Becoming Commissioner in 2015, his current responsibilities include transposition of the Energy Community acquis communautaire into Georgian legislation and stakeholder coordination. “I am honoured by the confidence my ECRB colleagues have placed in me”, the newly elected President underlined. “I am very much looking forward to continuing our excellent cooperation on regulatory issues of regional significance. Building on the expertise and experience established over the past years, I trust that, together, we can make the ECRB even stronger”, he added.

Regional projects for market coupling and cross-border balancing in the Western Balkans are kicked-off

On 19 and 20 December, regional projects for technical assistance to support day-ahead market coupling and cross-border balancing in the Western Balkans were kicked-off at meetings held under the Western Balkan 6 Initiative in Vienna. The objective of the technical assistance implemented by the Energy Community Secretariat is to assist the WB6 and neighbouring EU transmission system operators, national regulatory authorities and power exchanges in the preparation and implementation of market coupling projects and platforms for cross-border balancing cooperation. The projects are expected to be finalised by end 2018 as agreed under the Western Balkan 6 Memorandum of Understanding (WB6 MoU).

Unlawful destination clause in intergovernmental agreement on gas supply between Serbia and Russia to be dropped

According to media reports, the Presidents of Serbia and Russia have agreed to exclude a destination clause from the 2012 Intergovernmental Agreement on the supply of natural gas to Serbia. The compliance of the destination clause with European competition law was challenged by the Energy Community Secretariat in infringement Case-18/16 by the Secretariat.

Parliamentary Plenum adopts report highlighting importance of cross-border cooperation and acquis implementation to enhance security of energy supply

Yesterday, the Energy Community Parliamentary Plenum adopted the first ever report, the focus of which was security of energy supply. The report was co-drafted by Mr Lev Pidlisetskyi, Member of the Ukrainian Parliament, and Mr Claude Turmes, Member of the European Parliament. Efficient cross-border cooperation among Contracting Parties as well as EU Member States and complete compliance with the acquis was deemed essential for successfully ensuring security of energy supply. The plenum also expressed concerns regarding the outdated legislation on security of gas and electricity supply currently applicable in the Energy Community.

15th Ministerial Council Sets Vision for Post-2020 Climate and Energy Policy in the Energy Community

Convening under the Kosovo Presidency in Pristina today, the Energy Community Ministerial Council embarked on a process aimed at setting targets for renewable energy, energy efficiency and greenhouse gas emission reduction for 2030 in the Energy Community. The Contracting Parties will be supported by guidelines for the preparation of integrated National Energy and Climate Plans, adapted to fit the specificities of the Contracting Parties and soon to be presented by the Secretariat to the Community’s Energy and Climate Committee. The new mechanism will ensure a robust framework for streamlined reporting and transparent implementation of energy and climate policies. Individual Contracting Parties, such as Albania, expressed their willingness to integrate their energy and climate planning already now.

Secretariat decides not to initiate cases after successful mediation at the Energy Community Dispute Resolution and Negotiation Centre

In July 2017, the Secretariat and the authorities of Bosnia and Herzegovina signed a Settlement Agreement regarding the environmental permits of two planned large combustion plants (TPP Banovici and TPP Tuzla 7). The environmental permits were the subject of cases ECS-16/16 and ECS-17/16 against Bosnia and Herzegovina regarding incompliance with Energy Community acquis.

Secretariat kicks off the first Energy Community Regulatory School training

Conference addresses pressing issues concerning application of competition law in the energy sectors

The first Forum on Competition Law in the Energy Sectors, organised by the Energy Community Secretariat in cooperation with the Viennese law firm Binder Grösswang, took place yesterday at the Secretariat’s premises in Vienna.  Bringing together over 80 experts from the legal field, authorities and business, the event shed new light on topical issues of EU competition policy in the energy sphere, e.g. the European Commission’s case against Gazprom concerning the gas markets of Central and Eastern Europe as well as the interface between arbitration and competition law. The influence of market coupling and power exchanges on competition was also assessed.

Progress made on new gas interconnector between Ukraine and Poland

The Energy Community Secretariat acted as facilitator, as part of the Gas 2020 Agenda, between the representatives of transmission system operators and regulators of Poland and Ukraine in discussions on the status and further steps envisaged to construct the new Poland-Ukraine gas interconnector between the transmission systems of Gaz-System of Poland (Hermanowice node) and Ukrtransgaz of Ukraine (Bilche Volytsia UGS). High level meeting to resolve energy law deadlock in Bosnia and Herzegovina

Ministers for energy of both entities were also present. The meeting focused on overcoming Bosnia and Herzegovina’s breach of Energy Community law in the gas sector as the country has not transposed the Third or the Second Energy Package.

A delegation consisting of all key energy sector stakeholders participated in a three-day meeting in Vienna to finalize the country’s Energy Law and ensure its compliance with the Third Energy Package, based on a draft prepared by the Energy Community Secretariat earlier this year. The heads of the Ministry of Energy; Georgian National Energy and Water Supply Regulatory Commission (GNERC); Georgian State Electrosystem (GSE), a transmission system operator; Georgian Oil and Gas Corporation (GOGC), the country’s gas incumbent; Electricity System Market Operator (ESCO); Unified Energy System Sakrusenergo, the owner of the transmission grid; and the Secretariat joined the efforts to finalize the text of the law.

Secretariat urges Moldova to apply Energy Community law when designing tariff methodologies

Regulatory authority of Montenegro receives observer status in ACER Working Groups

The National Energy Regulator of Montenegro, RAE, is the first Energy Community regulator to have been granted observer status in the Gas and Electricity Working Groups of the Agency for the Cooperation of Energy Regulators (ACER). A related Decision of the Director of ACER has been communicated to RAE and the Energy Community Secretariat yesterday. A similar application by the regulatory authority of Serbia, AERS, was not confirmed positively by ACER for the time being.

Secretariat’s report takes stock of compliance with the Energy Community Treaty

Today, the Secretariat published its Annual Implementation Report, which provides a comprehensive overview of the progress achieved by the Energy Community Contracting Parties in implementing the acquis communautaire under the Energy Community Treaty. Six of the eight Contracting Parties have successfully completed the transposition of the Third Energy Package. An ongoing and persistent failure to perform prevails in Bosnia and Herzegovina and former Yugoslav Republic of Macedonia. As regards actual implementation of the acquis, the report concludes that the level achieved varies greatly.

Secretariat urges Moldova to properly transpose the Energy Performance in Buildings Directive

Today the Secretariat sent an Opening Letter to Moldova in Case ECS-14/16. Upon review of the national legislation, the Secretariat takes the preliminary view that Moldova failed to transpose or transposed incorrectly relevant provisions of the Directive 2010/31/EC on the energy performance in buildings.

Secretariat and USAID agree to strengthen partnership to support energy reforms

The Energy Community Secretariat hosted a meeting of 27 national and regional coordinators from USAID’s Bureau for Europe and Eurasia on 24 October 2017 in Vienna. The Secretariat and USAID presented their activities in the Energy Community Contracting Parties and agreed on future cooperation initiatives. On this occasion, Director Kopač, on behalf of the Energy Community Secretariat, and Acting Assistant Administrator, Margot B. Ellis, on behalf of USAID, signed a Framework for Cooperation (link to signed agreement). USAID also expressed its intention to cooperate with the Secretariat’s Dispute Resolution Centre.

Agency for the Cooperation of Energy Regulators and Council of European Energy Regulators in cooperation with the Secretariat produced the first ever pan-European Market Monitoring Report

on 25 October 2017

The Annual Report of the Agency for the Cooperation of Energy Regulators (ACER) and the Council of European Energy Regulators (CEER) on the Results of Monitoring the Internal Electricity and Natural Gas Markets presented in Brussels yesterday, includes data on the Energy Community Contracting Parties for the first time. The report covers statistics on household and industrial electricity and gas prices for the Contracting Parties as well as findings on gas wholesale developments in Ukraine. In many of the Contracting Parties, Russian supplies remain the only accessible gas source, mainly due to weak interconnection infrastructure and limited market liberalisation. However, Ukraine is ahead in implementing structural reforms with the goal to fully implement the EU gas market model.

EU4Energy stakeholders discuss key regional energy infrastructure projects

Yesterday, twenty representatives of five Eastern Partnership countries, including three Deputy Ministers for energy from Belarus, Georgia and Ukraine, gas and electricity transmission system operators and oil infrastructure operators, met to discuss potential candidate projects of regional interest under the auspices of the EU4Energy Governance project. Proposals aimed at connecting the Southern Caucasus region and Ukraine with its western neighbourhood were among the projects discussed.

Director discusses gas transit options with Ukrainian President Poroshenko

Yesterday, Director Kopač met with Ukrainian President Poroshenko to discuss future gas transit options and Third Energy Package implementation in the gas sector. Unbundling of the gas incumbent is one of the major obligations in that process and needs to be certified by the country’s national regulatory authority and by the Energy Community Secretariat. They agreed that the President will be regularly informed by the Secretariat on further developments related to that issue.

Secretariat continues to push for reform of Ukraine's Naftogaz

Secretariat issues Opinion on the Albanian regulatory authority's certification of gas TSO

Today, the Energy Community Secretariat published its Opinion of 2 October 2017 on the certification of the Albanian natural gas transmission system operator Albgaz under the Third Energy Package. The Opinion supports the certification of Albgaz in line with the Albanian regulatory authority’s (ERE) Preliminary Decision, subject to several requests for additional elaboration and conditions. Most notably, the Secretariat believes that changes to primary legislation are needed before Albgaz can be considered fully independent of the ministry in charge of energy.

CESEC 2.0 Bucharest meeting strengthens regional energy cooperation in Central and South-Eastern Europe

Regional energy cooperation in Central and South-Eastern Europe was discussed yesterday at the High Level Group Ministerial meeting of the Central and South-Eastern European Energy Connectivity (CESEC) Initiative in Bucharest. Representatives of eight Energy Community Contracting Parties and nine EU Member States gave political impetus to speeding up regional market integration between Energy Community Contracting Parties and EU Member States as well as realization of priority cross-border electricity and gas infrastructure projects.

Energy Community mediation clause in Ukrainian PPA agreements

On 14 September 2017, the Ukrainian regulator (NEURC) approved a regulation amending the template power purchase agreements (PPAs) between the State Enterprise “Energorynok” and economic subjects producing electricity with the use of alternative energy sources. The amendments touched upon several relevant areas: from now on, the execution of a pre-PPA will be permitted, the term of the PPAs is extended until 2028, and revenue streams can be assigned from the special purpose vehicle to a senior lender.

12th Gas Forum pushes for further regional market integration

Gathering more than 140 stakeholders, the 12th Gas Forum discussed the most pressing issues facing gas markets in the Energy Community Region and beyond. The Forum underlined that more efforts are required to integrate EU Member State and Contracting Party gas markets. Progress hinges in particular on the swift implementation of EU gas network codes in the Energy Community as well as improving the transparency and harmonisation of gas interconnection tariffs.

Secretariat requests reopening of the certification procedure for unbundling of EMS Serbia

Director discusses critical energy reforms with key stakeholders in Ukraine

During his visit to Kyiv yesterday, Director Kopač met with Ukrainian Vice Prime Minister Volodymyr Kistion. The meeting focused on the country’s Gas Sector Reform Implementation Plan 2.0, which outlines the necessary gas sector reforms to be achieved within the next two years. The unbundling of Naftogaz was also discussed.

The Energy Community Secretariat is assisting Moldova in developing secondary legislation in the areas of gas and electricity

Today, the Moldovan energy regulator, ANRE, and the Energy Community Secretariat concluded a Memorandum of Understanding which will be the basis of a closer cooperation between the two institutions in the coming months. The Secretariat commits to support the Moldovan authorities in developing secondary acts in the energy sector, so that the Third Energy Package is fully transposed.  A joint working group will prepare a list of the legislation which needs to be developed and a calendar according to which the respective acts will be drafted and adopted.

Secretariat issues opinion on unbundling of Serbian transmission system operator

Today, the Energy Community Secretariat published its Opinion on the certification of the Serbian electricity transmission system operator Elektromreza Srbije (EMS) under the Third Energy Package. In its Opinion, the Secretariat considers that EMS can currently not be certified as envisaged by the Preliminary Decision of the Serbian regulatory authority (AERS). This is because EMS is currently not unbundled in line with the ownership unbundling model as required by Article 9 of the Electricity Directive and it is still controlled directly by the Government, the representative of state ownership in both EMS and EPS, as well as in Srbijagas.

Ministers of energy and climate agree on joint action at informal Ministerial meeting

The first joint meeting of ministers responsible for energy and environmental/climate policy took place on 9-10 June 2017. The ministers discussed the best ways to contribute towards a low-carbon transition of the Energy Community region and endorsed the establishment of an Energy Community Climate Action Group composed of ministries responsible for energy and climate on the level of ministers or deputy ministers. The Group will convene twice per year and focus on integrated energy and climate planning in the Contracting Parties, to be coordinated also at the regional level.

Athens Electricity Forum: Progress towards creating a trading region in SEE - pace with EU energy policy developments must be kept

The Energy Community’s biggest annual conference on electricity took place on 31 May and 1 June in Athens. Gathering more than 120 stakeholders, the 22nd Electricity Forum stressed the need for the Energy Community to keep pace with EU energy policy developments in order not to widen the gap between Member States’ and Contracting Parties’ energy markets. The Forum therefore urged the adoption of electricity network codes/guidelines in the Contracting Parties as well as step-wise implementation of the EU Regulation on Wholesale Energy Market Integrity and Transparency (REMIT). The Forum further identified the need to better prepare the legal and regulatory framework for new and emerging market functionalities, such as integration of decentralized generation, self-consumption and demand response.

Florence Forum calls for adoption of electricity network codes in the Energy Community

Bulgaria joins WB6 regional electricity market integration initiative - all neighbouring EU countries are now on board!

The Bulgarian national regulatory authority (Energy and Water Regulatory Commission), the Bulgarian transmission system operator (Electricity System Operator EAD) and the Bulgarian power exchange (Independent Bulgarian Energy Exchange EAD) have formally declared their willingness to actively participate in the WB6 regional electricity market integration initiative. The new signatories of the WB6 Memorandum of Understanding will join the Programme Steering Committee on day-ahead market integration, whose task is to address all measures and steps needed for going-live of functioning day-ahead markets in and between the signatory countries.

Group of Observers publishes report on 2017 procurement of electricity in Moldova

The Group of Observes was constituted based on the “Guidelines for the Annual Procurement of Electricity to be used in the 2017 procurement” prepared by the Energy Community Secretariat in December 2016. To the extent possible, the Group of Observers attended the meetings related to the electricity procurement and reviewed the documents made available to them.

Participants of the second Energy Community Summer School are selected

The Secretariat in consultation with a network of academic and research institutions of the participating countries has selected the participants of the second edition of the Energy Community Summer School. Out of the 188 total applications submitted, 159 applicants met the selection criteria, of which the 40 most qualified were selected. Ensuring a geographical as well as a gender balance, the number of successful applicants is split 50/50 between men and women from 29 countries. The selected participants come from a wide variety of backgrounds, including government, postgraduate studies, research institutions, academia, private sector and non-governmental organisations.

All Contracting Parties’ price statistics now in EUROSTAT

With the State Statistical Service of Ukraine having successfully submitted the country’s price statistics, all Energy Community Contracting Parties’ statistics on prices of electricity and gas were for the first time disseminated by the EU’s statistical office, EUROSTAT, this month. All Contracting Parties thus fulfil the key requirements of the Energy Community acquis on energy price statistics (Directive 2008/92/EC).

Secretariat submits comments to the European Commission regarding Gazprom’s proposed anti-trust commitments

In 2015, the European Commission opened proceedings against Gazprom for potential breach of EU competition rules as regards gas markets in Central and Eastern Europe (Case AT.39816 – Upstream gas supplies in central and eastern Europe). In February 2017, Gazprom offered commitments pursuant to Article 9 of Regulation (EC) No 1/2003 to meet the competition concerns raised by the Commission. The commitments concern market segmentation, pricing and certain infrastructure arrangements by Gazprom vis-à-vis its customers. In order to test whether these commitments effectively remove the competitive concerns, the European Commission invited interested parties to submit their observations on the proposed commitments of Gazprom.

Secretariat issues Opinion on the Serbian regulatory authority’s certification of gas TSO

Today, the Energy Community Secretariat published its Opinion on the certification of the Serbian transmission system operator Yugorosgaz-Transport under the Third Energy Package. In its Opinion, the Secretariat considers that Yugorosgaz-Transport can currently not be certified as envisaged by the Preliminary Decision of the Serbian regulatory authority (AERS). This is because Yugorosgaz-Transport is currently not able to operate the transmission system effectively and independently from the system owner Yugorosgaz. Moreover, Yugorosgaz currently does not comply with the unbundling requirements itself. Finally, it has not been demonstrated that granting certification to Yugorosgaz-Transport will not put at risk the security of supply of Serbia and the Energy Community.

The meeting was co-chaired by Prof Jerzy Buzek, Chairman of Committee on Industry, Research and Energy of the European Parliament and Prof Muhamet Mustafa, Chairman of the Committee for Economic Development, Infrastructure, Trade and Industry of the Kosovo* Assembly and Chairman of the Energy Community Parliamentary Plenum.

The Energy Community welcomes Georgia’s accession

Yesterday the Georgian Parliament ratified the accession agreement with all 89 members of the Parliament present voting unanimously in favour. The Energy Community welcomes Georgia’s accession and the commitment for approximating Georgia’s energy sector with the European Union energy market rules. Notification of Georgian accession to the Energy Community therefore remains only a formality.

Energy Community Sustainability Forum to tackle key energy and climate challenges

The Sustainability Forum is a response to the continuous expansion of the Energy Community’s work, already covering energy efficiency, environment and renewables and soon also climate change, and the pressing need to establish a multi-stakeholder platform dedicated to the key energy and climate challenges facing the Energy Community Region. This is why the forum aims to gather all relevant stakeholders, including government officials, the private sector, representatives of civil society, non-governmental organizations and academia, to discuss the best ways to contribute towards a low-carbon Energy Community Region.

Mainstreaming sustainability – Progress in the lead up to Trieste Summit 2017

In the lead up to the WB6 Summit in Trieste (12 July 2017), the Western Balkan 6 countries have achieved progress in a number of measures of the Sustainability Charter. According to the Secretariat’s monitoring report published on 12 April, the market for energy services is advancing fast in Serbia, with the adoption of secondary legislation and project tendering in public buildings and street lighting. Work on implementation of the Energy Performance of Buildings Directive (EPBD) is also ongoing in all WB6 countries and recent progress was achieved by Albania and Kosovo* with the adoption of EPBD laws. In February 2017, the EU’s signature of EUR 50 million grant for the Regional Energy Efficiency Programme II (REEP Plus) and the Green for Growth Fund (GGF) will support building rehabilitation to reach minimum energy performance standards and implementation of other Sustainability Charter measures. In addition, several WB6 countries are working on establishment of national energy efficiency revolving funds. Nevertheless, more country ownership and political support is definitely needed to make full use of the existing programmes and develop national instruments for specific market segments.

On the one-year anniversary since the start of its construction, the Secretariat welcomes the progress achieved on the Serbian part of the 400 kV overhead interconnection line between Serbia and Romania, a key component of the Trans-Balkan Electricity Corridor. The Trans-Balkan Electricity Corridor, linking Montenegro, Bosnia and Herzegovina, Serbia and Romania via a 400 kV transmission line and Montenegro and Italy via a submarine cable, is of strategic importance for the Energy Community Region.

Electricity Procurement in Moldova: Clarification

On 31 March 2017, the electricity companies of Moldova awarded their annual power purchase contracts to the state-owned trading company Energocom. Contrary to earlier media announcements, the Group of Observers consisting of representatives of the Energy Community Secretariat, the EU Delegation to Moldova, the energy regulatory authority ANRE and the Ministry of Economy has not acknowledged that the tenders were organized in a transparent manner and in full compliance with the Procurement Procedures previously agreed with the Ministry of Economy. Such a conclusion would be premature. The Group had access to the tender documents and participated in meetings organized by GN Fenosa and the Ministry of Economy as well as in the bid opening sessions organised by GN Fenosa. Currently, representatives of the Energy Community Secretariat and of the EU Delegation are assessing the procurement process and will prepare a report on compliance with the Procurement Procedures.

In the framework of the 10th anniversary of Moldova’s Competition Council on 16 March 2017, the Council’s President Ms Viorica Carare and Ms Marie-Therese Richter, Energy Lawyer at the Secretariat, signed the Joint Declaration on the establishment of an Energy Community State Aid Network. State aid authorities in Albania and Bosnia and Herzegovina have already signed the declaration, whilst the authorities of the other Contracting Parties are expected to join the Network in the coming weeks.

Energy Efficiency Coordination Group adopts Work Programme 2017-2018 and elects new Chairman

At its March meeting, the EECG adopted a new Work Programme for 2017-2018 focused on the implementation of Directive 2012/27/EU on energy efficiency, national energy efficiency action plans (NEEAPs) and their monitoring, promotion of the exemplary role of the public sector and energy services, as well as coordination and promotion of existing donor support activities and regional initiatives (WB6 Sustainability Charter, REEP Plus, etc).

Secretariat escalates infringement case against Serbia for lack of participation in a regional platform for allocation of electricity cross-border capacities

On 17 March 2017, the Secretariat sent a Reasoned Opinion to Serbia for non-compliance of the national electricity transmission operator, Elektromreža Srbije (EMS), with its obligation under Energy Community law to participate in a regionally coordinated mechanism for allocation of electricity cross-border capacities. The Reasoned Opinion is the second step in the dispute settlement procedure initiated by the Secretariat in 2011. Despite various negotiations between the Secretariat and the Serbian parties since then, EMS at no point in time complied with the relevant obligations of the Energy Community acquis communautaire.

Secretariat requests Serbia to comply with competition legislation

Yesterday, the Energy Community Secretariat submitted a Reasoned Opinion to Serbia for its non-compliance with the competition acquis, as the next step in the dispute settlement case. In the Reasoned Opinion, the Secretariat reiterates its view expressed in the Opening Letter, that by ratifying an agreement requiring undertakings to adopt anti-competitive conduct in the sense of Article 18(1)(a) of the Treaty, Serbia deprived this provision of its effectiveness and thereby infringed its obligations under the Energy Community Treaty.
