The dispute was prompted by claims made in national courts against EVN Macedonia for unpaid electricity supplies dating from pre-privatisation times, in the amount of EUR 93 million plus interest. According to EVN, this was a breach of the share and purchase agreement it had entered into. EVN commenced arbitration proceedings against the former Yugoslav Republic of North Macedonia in May 2009. It claimed that it had been subject to discriminatory measures by the Government and individual state enterprises.

With the support of the mediator, a settlement agreement was signed in May 2011 and the arbitration proceedings were discontinued.
