Case
On 9 June 2026, the Secretariat sent an Opening Letter to Bosnia and Herzegovina concerning its alleged failure to comply with the unbundling and certification requirements under Directive 2009/73/EC.
Reasoning
In the Opening Letter, the Secretariat takes the view that, by failing to ensure proper unbundling and certification of the transmission system operator, Bosnia and Herzegovina has failed to comply with its obligations under Articles 9 and 10 of Directive 2009/73/EC.
Procedure
By sending the Opening Letter, the Secretariat initiated a preliminary procedure, the purpose of which is to provide Bosnia and Herzegovina with an opportunity to respond to the alleged non-compliance with Energy Community law within two months and to enable the Secretariat to establish the full background of the case and take account of any relevant developments.
