Case
On 21 August 2026, the Secretariat sent an Opening Letter to Ukraine concerning its alleged failure to comply with the cost-reflection principle and the non-discrimination principle when setting the tariffs for electricity DSOs.
Reasoning
In the Opening Letter, the Secretariat takes the view that, by failing to ensure cost-reflection principle and the non-discrimination principle when setting the tariffs for electricity DSOs, Ukraine has failed to comply with its obligations under Article 7 of the Treaty, Article 18 of the Regulation 2019/943.
Procedure
By sending the Opening Letter, the Secretariat initiated a preliminary procedure, the purpose of which is to provide Ukraine with an opportunity to respond to the alleged non-compliance with Energy Community law within two months and to enable the Secretariat to establish the full background of the case and take account of any relevant developments.
