Secretariat initiates dispute settlement procedure against Moldova for lack of unbundling of its electricity TSO

Today, the Secretariat submitted an Opening Letter to Moldova to address its failure to comply with the provisions on unbundling and certification of transmission system operators in Articles 9 and 10 of the Electricity Directive.

In the Opening Letter, the Secretariat preliminarily concludes that the transmission system operator (TSO) is not certified according to the ownership unbundling model, the only unbundling model eligible under Moldovan law. In the Secretariat’s assessment, the conditions of that model are not met, and require changes to the law in force. In particular, the TSO Moldelectrica does not own the transmission system. Five years after the legal deadline, Moldova is among the last Energy Community Contracting Parties where unbundling of the electricity TSO still needs to be achieved.
