    Competition Law

    The Law on Protection of Competition, adopted in 2010, as amended, and corresponding secondary legislation transpose the competition acquis.

    However, the Commission for Protection of Competition (CPC) has once again not carried out a single investigation in the energy sectors. In addition, CPC’s cooperation with the Secretariat and other national competition authorities in the framework of the Energy Community Competition Network is rather limited. Full compliance with the Treaty’s obligations requires active enforcement of the competition acquis.

    State Aid Law

    The Law on State Aid Control, adopted in 2010, transposes the State aid acquis into national legislation. CPC has adopted its first decision, approving secondary legislation on renewable energy support. However, the enforcement record on State aid in the energy sectors is very limited. There is also no commitment to the Energy Community State Aid Network. It follows that North Macedonia is not complying with the obligations stemming from the Treaty regarding effective enforcement of the State aid acquis.
