Procedural Act on the adoption of the BudgetIn accordance with the Article 74 of the Treaty, the Ministerial Council adopts the budget of the Energy Community by a Procedural Act every two years. For instance, the Ministerial Council approved the budget for the period 2008-2009 on 18 Dec 2007 and for the period 2010-2011 on 26 Jun 2009.

Auditor’s reports
Each year, the accounting officer establishes the previous year's accounts not later that 31 March. These accounts are subject to an audit by designated, independent, external audit company. The terms of service of the external auditors is for two years as specified by a Ministerial Council decision. The auditors submit their Audit Report to the Budget Committee and to the Ministerial Council for the period ending 31 December. The unqualified auditor’s opinion provides a basis for the discharge decision for the Director from his management and administrative responsibility.

Discharge of the Director
With reference to the Article 75 of the Treaty, the Director of the Secretariat is responsible for the implementation of the budget. The Budget Committee is expected to present the Auditor’s report to the Ministerial Council not later than eight months after the end of the financial years to which the accounts relate. On the basis of the Auditor's Report, the Ministerial Council decides on the discharge the Director.

Reports
Pursuant to the Article 75 of the Treaty, the Director has an obligation to report annually to the Ministerial Council on the execution of the budget.

Other procedural acts
The Procedural Act No.2006-03 lays down all the rules in relation to budget. As regards accounting rules and methods, the Secretariat applies the lnternational Public Sector Accounting Standards (IPSAS) as of 1 July 2007. The Annex IV of the Treaty sets out each Party’s contribution to the Energy Community budget. Following the accession of Moldova and Ukraine, the Annex IV was modified in Sep 2010.
