The Title VI of the Treaty of establishing Energy Community outlines the internal decision making process. The Energy Community may take measures in the form of recommendations, decisions or procedural acts. This gives rise to the Energy Community secondary legislation.
A Procedural Act has “binding force on the institutions of the Energy Community", and, if so provided, on the Parties. With it the Ministerial Council can delegate power to the Energy Community institutional organs. As a rule adoption of a Procedural Act necessitates unanimity.
Since the entry into force of the Treaty, the Energy Community has enacted the following procedural acts.
