The Skopje Ministerial Council requested the Secretariat to draw conclusions from the 2010 Implementation Report and to identify the next steps. In Mar 2011, the Secretariat presented to the PHLG a paper on how to boost the implementation of the Treaty. With the “Implementation Partnerships” as the point of reference, the paper proposes tougher reporting, particular scrutiny for those lacking behind and more affirmative action in case of non –compliance.

Based on the new approach, the Secretariat will pair descriptive reporting with normative reporting, where instances of non-compliance prevail. For this purpose, it will apply objective compliance templates for each nine Contracting Party on each policy area. As a principle, any draft legislation in the energy sectors should not be adopted without the Party having consulted the Secretariat in advance. To ensure continuous assistance, there will be detailed Party compliance profiles coupled with tailored missions. In the paper, the Secretariat also proposes “Implementation Partnerships” to all Parties in the form of Memoranda of Understanding. Here the idea is to establish an intra-Party working group composing of all stakeholders and co-ordinated by the Secretariat. The 19th PHLG welcomed the Secretariat’s report. |

Following an unprecedented co-operation between the Secretariat and the state institutions in charge of energy in Former Yugoslav Republic of Macedonia, a new law on energy was adopted in February 2011. To reach full compliance with the acquis, there is a need for a bundle of secondary legislation. In order to master the challenge, the Secretariat, Ministry of Economy and the Energy Regulatory Commission agreed to establish an implementation partnership on 8 April 2011. With the Memorandum, the state institutions in charge of energy in Former Yugoslav Republic of Macedonia agreed to adopt all the necessary secondary legislation in a timely and compliant manner. To this end, the Energy Regulatory Commission will not only involve all the domestic stakeholders in regular working groups, but it will also seek the Secretariat’s advice and expertise throughout the process. At the side of the Secretariat, Ms. Karolina Cegir, Gas expert, has been nominated to act as the focal point for the implementation partnership with Skopje. |

Based on intense cooperation between the Ministry, the Assembly and the Secretariat, three sets of electricity laws, namely a Law on Energy, a Law on the Energy Regulator and a Law on Electricity were adopted in October 2010. As a next step, appropriate and compliant electricity market model and additional secondary legislation had to be drafted and adopted without delay. It is on this background that the three parties agreed to sign the memorandum on implementation partnership on 21 April 2011. With the signatory of the Memorandum, the Energy Regulatory Office has agreed to establish working groups for different categories of secondary legislation. Consisting of all the domestic stakeholders, the working groups are expected to present its drafts to a steering committee in regular intervals. The steering committee will consist of the Chairman of the Energy Regulatory Office, the Director of the Secretariat and the Minister of Economic Development. Mr. Roland Matous, ECRB electricity expert, has been nominated to act as a focal point for the partnerhip from the Secretariat's side. |

On 9 June 2011, Moldova, as Energy Community Presidency in Office, hosted an international conference on “Moldova and the Energy Community” in Chisinau. The conference included the signing ceremony of a Memorandum on Implementation Partnership between the Ministry of Economy, the National Agency for Energy Regulation (ARNE) and the Energy Community Secretariat. As a precondition to the Energy Community’s accession, Moldova adopted new gas and electricity laws on 23 Dec 2009. In order to further align Moldova’s legal framework with that of the Energy Community Treaty, a shift in focus from primary to secondary legislation is now the needed, logical step. With the Memorandum, the Moldovan state institutions in charge of energy commit themselves to adopt all the necessary secondary legislation in a timely and compliant manner. To this end, the Ministry and ARNE will not only involve all the domestic stakeholders in regular working groups, but will also seek the Secretariat’s advice and expertise throughout the process. The Secretariat has nominated Ms. Gabriela Cretu to act as a focal point at the Secretariat's side. |
